1. Introduction

These Terms and Conditions ("Terms") govern your use of the Safe Summer online store at safe-summer.com and any purchase you make from us. By placing an order, you confirm that you accept these Terms. Please read them carefully before purchasing.

2. Products

We sell the SafeSleep Pillow and related products. All products are subject to availability. We reserve the right to discontinue any product at any time. Product descriptions, images, and specifications are provided in good faith and are as accurate as reasonably possible.

 

The SafeSleep Pillow is OEKO-TEX 100 certified and complies with applicable product safety regulations in the EU.

3. Pricing and Payment

•        All prices are displayed in USD and are inclusive of applicable taxes unless stated otherwise

•        Shipping is free worldwide on all orders

•        We accept major credit cards and other payment methods listed at checkout

•        Payment is processed securely via Shopify Payments

•        We reserve the right to adjust prices at any time; prices confirmed at the time of your order will apply to that order

•        In the event of a pricing error, we will contact you and you may choose to proceed at the correct price or cancel the order

4. Orders and Contract Formation

An order placed through our website is an offer to purchase. A binding contract is formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion (e.g. in case of stock issues, payment problems, or suspected fraud), in which case we will refund any payment made.

5. Shipping

Please refer to our separate Shipping Policy for full details on delivery times and carriers. Shipping is free worldwide on all orders. By placing an order, you agree to the Shipping Policy, which forms part of these Terms.

6. Returns and Refunds

Please refer to our separate Return and Refund Policy. We offer a 100-day satisfaction guarantee in addition to your statutory rights. EU consumers also have a statutory 14-day right of withdrawal. The Return and Refund Policy forms part of these Terms.

7. Warranty and Product Condition

Our products are covered by the statutory legal guarantee under EU consumer law (2 years from delivery for goods with defects present at the time of delivery). If you receive a defective or damaged product, please contact us within a reasonable time.

 

The SafeSleep Pillow outer layer is washable at a maximum of 40 degrees Celsius (110 degrees Fahrenheit) and should be air dried. Damage resulting from improper care or use is not covered by the warranty.

8. Intellectual Property

All content on the Safe Summer website, including text, images, logos, and product descriptions, is the property of Safe Summer or its licensors and is protected by applicable intellectual property law. You may not reproduce, distribute, or use any content without our prior written permission.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

•        Safe Summer is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website

•        Our total liability for any claim shall not exceed the amount you paid for the product in question

•        We are not responsible for delays or failures caused by circumstances beyond our reasonable control (force majeure), including but not limited to natural disasters, pandemics, or carrier disruptions

 

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Dutch or EU law.

10. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes will be submitted to the competent courts of the Netherlands, without prejudice to your rights as a consumer under the laws of your country of residence.

11. Amendments

We reserve the right to update these Terms at any time. The version in effect at the time of your order applies to that order. We encourage you to review these Terms periodically.
